Carrie & Co. Cactus

These Terms of Service (“Terms”) govern your access to and use of the Carrie & Co. Cactus website and your purchase of products from Carrie & Co. Cactus (“Carrie & Co.,” “we,” “us,” or “our”).
By accessing our website or purchasing from us, you agree to these Terms.
1. Products
Carrie & Co. Cactus specializes in live cactus, succulents, and related products, including rare and collectible specimens.
Plants are living organisms and naturally vary in appearance. Color, shape, hydration, roots, spines, farina, growth, flowers, and other characteristics may change over time or during shipping.
Unless a listing states otherwise, photographs of individually listed specimens are intended to represent the actual plant being offered.
Minor changes in appearance between photography and delivery are normal and are not necessarily evidence of damage or misrepresentation.
2. Plant Identification
We make reasonable efforts to accurately identify the plants we sell.
Plant identification, cultivar names, locality information, hybrid status, and other botanical information may sometimes depend upon information supplied by growers, collectors, importers, or previous owners.
Unless specifically represented as documented provenance, botanical identification and cultivar information should not be interpreted as a guarantee of genetic identity or provenance.
3. Orders
All orders are subject to acceptance and product availability.
We reserve the right to refuse or cancel an order when reasonably necessary, including because of inventory errors, pricing errors, suspected fraud, website errors, shipping restrictions, or circumstances that make lawful or safe fulfillment impractical.
If we cancel a paid order, the applicable purchase amount will be refunded.
4. Pricing
Prices are displayed in U.S. dollars unless otherwise stated.
We may change prices at any time. A price change does not affect an order that has already been accepted except where correction is necessary because of an obvious pricing or website error.
Applicable taxes and shipping charges may be added at checkout.
5. Shipping
We package plants carefully for shipment, but live plants may experience temporary cosmetic or physiological changes during transit.
These may include:
Wrinkling or dehydration
Minor soil or top-dressing displacement
Minor spine damage
Loss of flowers or buds
Minor leaf or tubercle damage
Temporary color changes
Minor cosmetic blemishes
These conditions do not necessarily indicate that a plant is unhealthy.
Customers are responsible for providing a complete and accurate shipping address.
Carrie & Co. Cactus is not responsible for delays caused by shipping carriers, weather, natural disasters, incorrect addresses, or other circumstances outside our reasonable control.
6. Weather and Heat Packs
Customers are responsible for considering weather conditions at their destination and along the shipping route when ordering live plants.
When available, we recommend purchasing a heat pack when temperatures during transit may fall below approximately 50°F.
A heat pack reduces cold-weather risk but cannot guarantee that a plant will not experience cold damage.
We may delay shipment when we reasonably believe extreme weather presents a substantial risk to the plant.
7. Receiving Your Plant
Customers should promptly retrieve and unpack live plants after delivery.
Plants should be inspected upon arrival and gradually acclimated to their new environment. Newly shipped plants should not automatically be placed into intense sunlight or subjected to excessive watering immediately after arrival.
Care requirements vary considerably by species, season, root condition, climate, and growing environment.
8. Shipping Damage and Problems
If a plant arrives with significant shipping damage or another material problem, contact Carrie & Co. Cactus promptly after delivery.
Please provide:
Your order number
Clear photographs of the plant
Photographs of the packaging and shipping box
A description of the problem
We may request additional photographs or an unboxing video when necessary to evaluate a claim.
Do not discard the plant or packaging until the issue has been resolved.
Depending on the circumstances, we may offer an appropriate resolution such as replacement, store credit, partial refund, or refund.
9. Returns and Live Plants
Because plants are living and perishable products, all live-plant sales are generally final.
We generally do not accept returns based on buyer preference, normal shipping-related changes, or growing conditions occurring after delivery.
This policy does not limit any rights that cannot legally be waived.
If there is a genuine problem with your order, contact us promptly so that we can evaluate the situation.
10. Plant Growth and Survival
We cannot guarantee a plant's future growth, appearance, flowering, variegation, propagation success, or survival after it has been delivered.
Plant health after delivery can be affected by numerous circumstances outside our control, including watering, soil, temperature, humidity, light intensity, pests, disease, fertilizer, repotting, dormancy, and acclimation.
Information we provide concerning cultivation is general guidance and does not guarantee a particular result.
11. Legal Restrictions
Customers are responsible for determining whether a plant may lawfully be purchased, possessed, grown, or delivered in their location.
We reserve the right to decline shipment to locations where legal, agricultural, carrier, or other restrictions prevent or materially complicate shipment.
12. Website Content and Intellectual Property
Unless otherwise stated, the Carrie & Co. Cactus website and its original photographs, graphics, branding, logos, written content, product descriptions, designs, and other original materials are owned by or licensed to Carrie & Co. Cactus.
You may use the website for personal, non-commercial purposes.
You may not reproduce, republish, sell, distribute, scrape, commercially exploit, or falsely represent our original content as your own without permission.
13. Prohibited Use
You may not use our website to:
Violate applicable law
Commit or facilitate fraud
Interfere with website security or operation
Introduce malicious software or code
Attempt unauthorized access to accounts or systems
Harvest information about other users
Infringe intellectual-property rights
Misrepresent your identity or affiliation
14. Third-Party Services
Our website may rely upon or link to third-party services, including payment processors, shipping carriers, social-media platforms, and other websites.
We are not responsible for third-party websites or services that we do not control.
15. Disclaimer
To the extent permitted by applicable law, our website and informational content are provided on an “as available” basis.
Because we sell living plants, we cannot warrant that every plant will remain identical in appearance to its listing photograph or respond identically to particular growing conditions.
Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
16. Limitation of Liability
To the fullest extent permitted by applicable law, Carrie & Co. Cactus will not be liable for indirect, incidental, special, or consequential damages arising from use of the website, use or cultivation of a product, or circumstances outside our reasonable control.
To the extent permitted by law, our liability relating to a purchased product will not exceed the amount paid for the product giving rise to the claim.
17. Governing Law
These Terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law principles, except where applicable law requires otherwise.
18. Changes to These Terms
We may update these Terms periodically.
Changes become effective when the revised Terms are posted to our website, unless otherwise stated.
